Retreat Terms & Conditions

I confirm and agree that the following terms and conditions and undertakings apply to all activities to be provided to me by With Heart Retreats (also referred to as “WHR”).

​Payment

I understand that there is a non-refundable deposit of $750.00 in order to secure my spot. I acknowledge that there are no exceptions to this policy, for any reason, and that it is my responsibility to ensure I can attend the retreat before placing a deposit. 

I acknowledge that payments are to be made in full 21 days prior to the retreat start date and that these payments are non-transferable and non-refundable. If I do not submit payment within the stipulated time frames, then WHR reserves the right to open my reservation to another attendee and I forfeit any monies paid.

I agree to pay any additional fees (including international transaction fees) that either booking systems or my bank may charge me.

Travel Arrangements

All travel arrangements are my responsibility and at my own cost. WHR shall not be held liable for any consequences arising from delays or cancellations in any of the companies I may have made arrangements with, or for any irregularities in my documentation required for travel. Transfers to/from the retreat are at my own cost, unless otherwise specified.

Cancellation

It is my responsibility to read and understand WHR’s cancellation policy before making a reservation. I understand that WHR recommends that I purchase travel cancellation insurance to cover any possible losses.

For cancellation requests submitted with 60 days or more of the retreat start date: the total retreat fees paid, less my deposit, will be refunded to me. 

For cancellation requests submitted with 59 days or less of the retreat date start date: no retreat fees will be refunded to me.

I understand that for any unused portion of the retreat, there will be no refunds.

To cancel, I must make a cancellation request in writing, by 11:59p AEST, within the stipulated time frames outlined above.

WHR reserves the right in any circumstances to cancel a retreat, at all times up to and including the first day of the retreat at its sole and unfettered discretion. If WHR terminates this contract for the reasons outlined above, then WHR will offer a credit (to be used within 12 months) to me equal to the amount of money I paid, to spend on any service provided by WHR.

Travel/Cancellation Insurance

WHR has recommended that I purchase travel/cancellation insurance to cover any possible loss. If I choose to buy insurance, it is required that my travel insurance covers the activity of this retreat as well as unexpected cancellation, sickness, losses and all the usual risks. I will bring the policy with me to the retreat in case of an emergency.

Health

I will faithfully follow all instructions given to me by WHR and its owners, facilitators, teachers, contractors, and assistants as to when, where, and how to perform and not to perform activities.

I will be mindful at all times of my own body’s capability during the retreat. If I experience any injury or discomfort during any activity during the retreat, then I will desist immediately. 

It is my responsibility to advise WHR and its facilitators of any mental or physical health conditions and dietary requirements when I book. If I have health conditions and dietary requirements that may be affected by the activities offered on the retreat, WHR reserves the right to advise me to desist and in the interests of my wellbeing, or others, they may decline my stay at the retreat.

It is also my responsibility to consult a doctor with an understanding of physical activity to check that I am sufficiently fit and healthy to undertake any activities that I may choose to do whilst on the retreat.

If I am 12 to 28 weeks pregnant, I will provide a letter from my health practitioner specifying that I am fit to travel and able to engage in the retreat activities that are provided. 

I acknowledge that whilst all measures are taken to ensure a high standard of health and safety, retreats are situated in countryside locations where the land is uneven, sometimes on farms, with animals and insects, and WHR shall not be responsible for any injuries caused.

I agree to any mandatory health rules and declarations on arrival to the retreat, including body temperatures taken prior to entering the retreat, wearing face masks and/or whatever the local rules restrictions are currently abiding by. 

I agree and acknowledge that participation in any of the retreat activities could constitute a risk of serious injury to myself, including permanent paralysis or death. I voluntarily and knowingly recognise, accept and assume this risk and warrant that I am physically fit and able to perform the activities without risking serious injury, including permanent paralysis or death.

I acknowledge that neither WHR, its owners, facilitators, teachers, contractors, and assistants be deemed responsible or liable (whether in contract or in tort or under any statute whatsoever), for any injury, illness, medical or psychiatric conditions, which may develop during or subsequent to the retreat or other mishaps I sustain arising from or out of, or in any way directly or indirectly connected with the activities.

I understand and acknowledge that I am to receive instruction and facilitation for retreat activities and that WHR, its owners, facilitators, teachers, contractors, and assistants, are not liable for, nor expected to provide any advice, training or medical assistance other than in the instruction of retreat activities.

Force Majeure / Covid-19

I acknowledge that there is no cancellation refund for any reason including, but not limited to, natural disasters, acts of terrorism, pandemics, illness, health conditions, medical or personal or family or work emergencies, or change of mind. If I cannot reach the retreat due to unforeseen circumstances of any reason including, but not limited to, strikes, travel bans, weather circumstances, and missed, delayed or cancelled flights, my retreat fees are non-refundable and non-transferable.

Complaints

I understand that if I have an issue during the retreat, I will inform the facilitator immediately, who will endeavour to put things right. 

I understand that WHR is not responsible for the individual behaviour of any group member or other guest sharing my accommodation. 

I understand that WHR reserves the right to refuse or remove a participant from the retreat if their behaviour is disturbing or disruptive to the facilitator or the group. In the event of such dismissal, any refunds will be at the sole discretion of WHR and refunds will not be made for travel, meal or accommodation packages booked.

Amendments By With Heart Retreats

I acknowledge that occasionally, changes may have to be made (e.g., schedule of activities, covid restrictions or other arrangements), which WHR reserves the right to do at any time. If my accommodation has to be changed, WHR will do their utmost to provide accommodation of a similar rating, but there are no guarantees to me. If a significant change becomes necessary, I will be informed by WHR as soon as reasonably possible.

​Liability 

I indemnify and will at all times hereafter well and sufficiently indemnify and keep fully indemnified WHR, its owners, facilitators, teachers, contractors, and assistants of WHR from and against all actions, suits, causes of action, proceedings, claims, costs and expenses whatsoever which may be taken or made against WHR, its owners, facilitators, teachers, contractors, and assistants of WHR, incurred or become payable by WHR, its owners, facilitators, teachers, contractors, and assistants of WHR in connection with or arising out of any such injury, illness or mishap to me on retreat with WHR.

I understand that WHR does not accept any liability for cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster, technical problems to transport, staff cancellations, unforeseen changes in my personal circumstances or other events beyond WHR’s control.

It is my responsibility to ensure that my possessions are kept safe at all times while during, or transporting to or from the retreat. This includes hire cars or other hired equipment.

Group Bookings

If a booking is made on behalf of several individuals, the booking is conditional on the person(s) paying having authorization from all the individuals named on the booking form to enter into this contract. If my booking was made in a group booking, the terms of this contract applies to me as though I had paid for my own retreat individually and directly to WHR.

Photography and Videography

I, for good and valuable consideration, hereby irrevocably authorise WHR to use photographs and/or videos of me and or my property and authorise WHR and it's assignees, licensees, legal representatives and transferees to use and publish (with or without my name) photographs, pictures, portraits, videos or images in any and all forms and media and in all manners including composite images or distorted representations, and the purposes of publicity, illustration, commercial art, advertising, publishing (including publishing in electronic form on CDs or internet websites), for any product or services, or other lawful uses as may be determined by WHR. I further waive any and all rights to review or approve any uses of the images, any written copy or finished product.

I am of full legal age and have read and fully understand the terms of this release.
